Resumen: El persistente interés por la categoría del derecho subjetivo se desprende del carácter nuclear y polémico de su significado alcance en los ordenamientos jurídicos y en la Teoría del Derecho. Este artículo toma como punto de referencia para una reflexión sobre el derecho subjetivo, sus críticas y sus actuales reivindicaciones, la obra del profesor Máximo La Torre: La lucha contra el derecho subjetivo. Karl Larenz y la teoría nacionalsocialista del Derecho, recientemente publicado en edición castellana. Su autor es catedrático de Filosofía del Derecho en la Universidad italiana de Catanzaro y un cualificado exponente de la cultura jurídica europea actual. El análisis y comentario de este libro se propone explicar las causas y circunstancias en que se produjo el asedio nacionalsocialista al derecho subjetivo, de modo especial a partir de las tesis de Karl Larenz.

Abstract: The persistent interest in the theme of subjective rights can be understood from the nuclear and controversial character of its significance in the systems and in the Theory of Law. The work by professor Massimo La Torre: The Fight against Subjective Rights. Karl Larenz and the National Socialist Theory of Law (recently published in its Spanish version), is taken here as a point of reference for a reflection on subjective rights, its critiques, and its current claims. La Torre is Head of the Department of Philosophy of Law in the University of Catanzaro, in Italy. He is also a qualified representative of the current European legal culture. The analysis and the commentary of this book are aimed at explaining the causes and the circumstances of the National Socialist assault on subjective rights, in particular based on Karl Larenz’s theories.
