Krausismo Español Y Derecho. Una Visión Crítica

Resumen: La filosofía krausista ha ocupado un lugar privilegiado en la historia contemporánea española, porque fue decisiva en la llegada de los procesos de la Ilustración, vinculados a los principios de secularización y de democratización; y porque sus aportaciones al campo de la educación trajeron nuevos panoramas de democracia para la sociedad española, que cristalizarían en la Constitución de 1931. Sin embargo, no logró evitar el déficit de conocimiento social de la ciencia jurídica moderna española, que acabaría derivando, como reclamo de la burguesía liberal, hacia procesos de absolutización de sus categorías (dogmática) y de formalización jurídica de los derechos, que se empiezan a pensar exclusivamente como derechos individuales.

Abstract: The Krausist philosophy has has a privileged position in the Spanish contemporary history because of two main reasons. The firts one is the crucial role of this philosophy in the arrival of the processes of the Age of the Enlightenment, linked to the principles of secularization and democratization. And the second one is its contribution in the field of education, that brought a new outlook of democracy for the Spanish society. This contribution would result in the Constitution of 1931. However, the Krausist philosophy could not avoid the shortage of social knowledge of the Spanish modern legal science that would turn to the processes that precised about its categories and the legal formulation of rights.
