Resumen: Dentro del marco de reformas del sistema de la ONU, la Asamblea General de la ONU creó el 15 de marzo de 2006 el Consejo de Derechos Humanos como sustituto de la Comisión de Derechos Humanos y estableció su marco normativo de actuación. Después de haber concluido en su primer año de trabajo las pautas básicas de su proceso constitutivo y empezando su segundo año dedicado propiamente a los temas de su mandato y a la puesta en marcha del nuevo mecanismo del Examen Periódico Universal, se hacen presentes críticas a su labor. Este trabajo pretende ante todo arrojar luz sobre las verdaderas innovaciones que trae la creación del Consejo. Ello es posible echando una mirada a sus fines, funciones y estructura, teniendo como indicador a la Comisión.

Abstract: The General Assembly of the United Nations created the Council on Human Rights on March 15, 2006 within the framework of reforms of the United Nations System as a substitute for the Human Rights Commission and established its normative framework. After having concluded the basic guidelines of its constitutive process in its first year and beginning its second year dedicated to the themes of its mandate as well as starting the new mechanism of the Universal Periodic Review, critics make appearance on its work. It is the purpose of this paper to attempt to shed light on the genuine innovations that the creation of the Council has brought about, including a look at its motives, functions and structure as well as its relevance to the Commission.
