El Estado y las relaciones laborales en Francia

Resumen: El Estado francés interviene en las relaciones laborales. Legisla y reglamenta, incentiva y enmarca, concilia y arbitra. Francia se caracteriza por el rol central del Estado y de la legislación social desde las primeras leyes sobre el trabajo. No en vano, la internacionalización creciente de la economía, la afirmación de nuevos polos de regulación en los niveles europeo y regional, así como el papel creciente de la empresa en materia de producción normativa, tienden a debilitar al Estado. En realidad, nos encontramos ante un cambio profundo de su papel y de sus modalidades de acción. La visión de un Estado “regaliano”, omnipresente, que ejerce una autoridad exclusiva sobre el territorio, es sustituida por la representación de un Estado más disperso. Un Estado cuyas decisiones y acciones resultan de unos procesos de negociación que asocian múltiples actores, tanto públicos como privados.

Abstract: The French State is present in the profesional relations. It legislates and regulates, incites and frames, conciliates and arbitrates. France is characterized by the central role of the State and the social legislation from the first laws about work. The increasing internationalization of the economy, the affirmation of a new poles of regulation in the European and regional levels, as well as the increasing role of the company in the production of norms, tend to debilitate the State. In fact, we are in front of a change of his forms of action. The vision for the “regalian” State, omnipresent, with an exclusive authority exercises on the territory, replaces the vision of the more dispersed State. A State which decisions and actions results from a few processes of negotiation that associate many actors, publics and privates.
